Objection and appeal
If you disagree with a decision of the BIG register, you can send an objection. Do you disagree with the decision on your objection? Then you can appeal to the court.
Do you have questions about a decision? Please contact the Customer Contact Center. Always mention the reference number that is on the decision.
Letter of objection
If you disagree with a decision, you can send an objection. Do this within 6 weeks after the date stated at the top of the letter with the decision. Be on time, otherwise your objection cannot be processed.
Include your name and address, the date and the reference number of the letter in the objection letter. This reference number is in the right margin. Indicate why you disagree with the decision. Do not forget to sign and date the letter, otherwise the objection will not be valid.
Send the notice of objection by post to:
Ministry of Health, Welfare and Sport
Directorate of Legislation and Legal Affairs
P.O. Box 20350
2500 EJ The Hague
You can also email your objection to: WJZ.bezwaarenberoep@minvws.nl .
Pro forma (provisional) objection
It is also possible to send a pro forma (provisional) objection. This means that you file an objection and write at a later time why you disagree with the decision. This ensures that you have filed an objection in time, even if you do not yet know exactly what your objections are.
The consequences of this decision
The consequences of this decision do not stop if you object. This means that you will not be registered yet.
What happens to your objection?
The Directorate for Legislation and Legal Affairs (WJZ) of the Ministry of Health, Welfare and Sport will handle your objection. It may request advice from the VWS committee on objections to the General Administrative Law Act (Awb). The committee on objections will listen to both opinions and will provide advice.
During a possible hearing on the objection, you can give your opinion. The civil servant who prepared the decision does the same.
The director of the WJZ management ultimately makes a decision on the objection. You will receive that decision with any advice from the objections committee by post.
Please note: Even if you file an objection, your name will be removed from the BIG register (crossed out) on the date stated in the decision. If your objection is upheld, the deletion will be reversed.
Decision not to process
If your application for re-registration is not entirely complete, you will receive a 'decision not to process'. For example, if supporting documents are missing or if you have not paid for the re-registration. You can also appeal against this.
Appeal
Do you disagree with the decision on the objection? Then you can appeal to the court. What you need to do for this can be read at the bottom of the decision on the objection. You can appeal against a decision of the court to the Council of State.
